Compensation claims hospitals and clinics because of PIP implants – nrc.nl

Dutch women put four hospitals and two private clinics liable for the dangerous PIP breast implants that are placed on them.

This writes the Algemeen Dagblad this morning. SAP Lawyers steps on behalf of the women to court. So far, the right care never imposed damages because of a law that stipulates that ‘unreasonable’ to hospitals and doctors liable for defective medical devices.

According to SAP Lawyers is that clause however dated. Personal Injury Lawyer June van Oers said to the newspaper:

“Patients are ignorant and rely on information from the doctor. They trust that the knowledge and made a good decision about the use of medical devices. It is reasonable to place the risk with the doctor or hospital has made the choice of implants. “

Many women were given charge of their health by the implants of the (now bankrupt ) French producer PIP, because the silicone gave an increased risk of leakage and (illegally) contain industrial gel. The company thus began in 2001 to cut costs – industrial gel is about 90 percent cheaper than medical gel. A ban on silicone implants in the US, revenues decreased. PIP exported to countries around the world.

The Dutch importer, ROFIL is bankrupt, so their victims can no longer harm stories here. In the Netherlands were between 1,100 and 1,400 women called for removal of the implants, but many patients could not be traced, since there was no central register. Possibly the number of Dutch women with PIP implants is therefore higher.

The head of PIP, Jean-Claude Mas, was sentenced to four years in prison and a fine of 75,000 euros for fraud and deception. He may never have a function in the medical world. Other highly placed persons have been convicted within the company. The lawsuit against Mas was one of the largest ever, there were more than 7,000 plaintiffs and about 300 lawyers involved
