More lawsuits WMO – Focus on News

The number of lawsuits over the Social Support Act (WMO) is the first half of this year increased considerably. Since the introduction of the new Social Support Act on 1 January 2015 1,000 people have gone to court because of a conflict with their municipality about the reimbursement of services such as domestic help. In previous years, there were an average of 550 per half year. That’s an increase of about 80 percent.

The WMO 2015 regulates the support that people sometimes need to independently attend and participate in social life. The municipality therein has an important role. Those people need help, if necessary, for example, adaptations to the home, buying a scooter or collective taxi service for the disabled. The reimbursement of home care for people who can not clean, falls under the SSA. Over there is much to do because municipalities have cut back considerably and therefore reimburse less household care. They need that first consult with residents, which is not always done. About how far churches should go in it, is regularly litigated.



Theme Session

The court northern Netherlands tomorrow serve four soil issues on domestic workers under the SSA. The court deals with these issues on a theme session to address a number of fundamental questions, such as the old or the new WMO applicable, what about the transitional law and to what extent remains domestic help under the new law the responsibility of the municipality
