That’s what judges of the State Council Wednesday determined in an appeal that was lodged by Bits of Freedom.
The organization wants to statistics on wiretapping, but the minister refuses to give it. The Minister must make a new assessment and if he maintains that the information remain confidential, this must be explained better.
According to the minister would take it out to give much value the information about the process , focus and strength of the AIVD. However, that reasoning is not sufficiently substantiated to keep the information behind, concludes the Council of State.
Secret
It’s about a case from 2014. Bits of Freedom has then tapping statistics 1971 to 2013 obtained from the Minister. Only the statistics were delivered about 1991 to 2001, 1984, 1985 and 1986.
On the other periods in 1991 were no statistics. Information about tapping from 2001 to 2013, according to the minister secret.
Bits of Freedom noted that supervisor CTIVD remarked that the tapping statistics are not identified in a report in 2014 as a state secret.

The new aftapwet for security services includes a so-called dragnet which can be broken into computers of innocent people as being criminals can be caught.
“If Plasterk now is not open on the statistics, how does that if the new law is there?” Zenger calls.
Other business
The State Council earlier this year in another case even though Plasterk asked to better explain why he would not disclose details. In addition, it was also about tapgegevens which would not give the minister because that would be secret.
Bits of Freedom hopes to Plasterk’s statements seriously and still come out with the data. “But it’s hard to say if that really happens,” says Zenger
