Cassation after acquittal murder Vivica Spong – Dutch Newspaper

 
 


 

ARNHEM (Reuters) – The Public Prosecutor (OM) get to the Supreme Court is now the 44-year-old from Utrecht Mark D. Tuesday was acquitted for the second time of murdering Vivica Spong and their unborn son Julian . That made it OM Wednesday.

After the court previously ruled Tuesday the Court of Appeal in Arnhem also that there is not enough evidence for murder against 44-year-old Van D. The prosecution had demanded precisely twenty years in prison.

The 31-year-old Vivica Spong was found dead at the bottom of the stairs, where Van D. suggested that she had fallen down the stairs. Although strangulation could not be demonstrated, it seemed more likely than a fall down the stairs.

Lie

Both court as a court considered it proven that Van D. lied incredible. He argued constantly with his story as it appeared that his allegations could not be beat, trying to conceal that he was the morning of her death in the home and obscured a boxer with blood on her.

Also, Van D. searched the internet for ways to kill without trace and intoxicants. Tracks that you can expect lacked a fall down the stairs.

Heavy

The court abhors them, according to the arrest Tuesday that Van D. as ‘n load heavy suspicion in itself, without giving disclosure. But because of death and motive are not clearly become, there is insufficient evidence for murder.
